The ITIN for non-residents: when you actually need one — and the four traps of Form W-7
Half the people who apply for an ITIN don't need one — and the other half apply badly and wait months longer. Here's when it actually applies, the four classic Form W-7 traps, and how to keep your passport out of an envelope.

What it is — and what it is not
The ITIN (Individual Taxpayer Identification Number) is the IRS tax ID for people who don't qualify for an SSN. It exists to meet US tax obligations. It is NOT a work permit, gives NO immigration status, and is not the same as the EIN — which belongs to your company, not to you.
Mistake number one: applying "just in case" to open an LLC or a bank account. You do NOT need an ITIN to form an LLC or get its EIN, and most fintechs don't require it either. Applying without a valid reason = automatic IRS rejection.
When it DOES apply
- You must file a US return: the classic case — a 1040-NR for US-source income like a rental property. The W-7 travels WITH that return.
- You're claiming a treaty benefit: certain situations require an ITIN under a specific W-7 exception, no return attached.
- You're a spouse or dependent on someone's return.
- A withholding or form explicitly requires it: FIRPTA real estate sales, certain brokers, some platforms.
The four W-7 traps
Trap 1 · Mailing your original passport to the IRS. The standard route — and weeks without a passport. Alternatives: a Certifying Acceptance Agent (CAA) who certifies it without sending it, or an IRS assistance center with an appointment. Exhaust both before using an envelope.
Trap 2 · The wrong exception box. Each valid reason has its own box and supporting documents. The most common cause of rejection — and every rejection costs weeks.
Trap 3 · Filing it alone when it had to travel with the return. If your reason is "I must file", the W-7 goes WITH the 1040-NR, not separately.
Trap 4 · Not renewing. An ITIN unused on returns for three consecutive years expires — renew before filing again.
Real timelines
As a current reference, a well-filed W-7 takes 7 to 11 weeks — longer in high season. Anyone promising an "ITIN in days" is selling smoke: the IRS issues the number, and nobody can rush it.
